RECORD OF THE FIRST GENERAL ASSEMBLY HELD AT THE EUROPEAN COURT OF JUSTICE, LUXEMBOURG ON 26 APRIL 2004 (15.00 – 17.00 h)

 

1. Presentation of the Statutes of the European Union Forum of Judges for the Environment

The Statutes are presented by Prof. Dr. L. Lavrysen, Judge with the Cour d’Arbitrage/Arbitragehof/ Shiedshof (Brussels - Belgium).

The discussion revealed that some clarifications must be considered in a following meeting of the General Assembly.

It was underlined that membership of judges is on personal title, but that the forum seeks to have representative members of the different judiciaries. The General Assembly is composed of 1 judge per member state of the EU or the EFTA and per European Court. Per member state and per European Court there can be 1 substitute member that has voting right in absence of the effective member.

Each judge of a member state of the EU or the EFTA or working in a European Court can be, without limitation, be ordinary member of the Forum, not being a member of the General Assembly.

Judges of states who applied for membership of the European Union can be member-observers.

Representatives of UNEP, the European Commission and the Council of Europe can follow all meetings and activities of the Forum in an observer capacity. Such a capacity can be given to other international organisations and ngo’s subject to approval of the General Assembly.

The question of membership contributions was raised, but postponed. The Board is asked to propose criteria for allowing observership of international ngo’s.

4. Working Programme

The questionnaire was presented by Dominique GUIHAL and discussed. The questionnaire was accepted as a guideline for producing national reports. A reference to constitutional courts must be included.

The timetable is adjusted. The national reports must be introduced for the end of September.

 

5. Next meeting

The next meeting is scheduled for early December in The Hague or Brussels, depending on the outcome of the negotiations with the Dutch Environmental Ministry.
